New Delhi: A petition seeking CBI probe in the bar bribery scam in which former finance minister K M Mani is an accused was rejected by the Supreme Court on Friday. The court clarified that it cannot intervene in a case which is being investigated by the vigilance.

The apex court also said that it can be informed at a later stage if there is any lapse in the investigation.

It was on the petition submitted by BJP state committee member Noble Mathew, the Supreme Court bench comprising of justice Ranjan Gogoi and justice R Bhanimati took the decision.

Mathew had alleged that the vigilance has no interest in prosecuting Mani and hence the investigation needs to be handed over to the CBI.

Meanwhile, Mani responded by saying that the SC’s ruling was welcome and a relief.

Mani resigned as finance minister in November 2015 after an adverse remark by the High Court in a related case. He had also severed ties with the Congress-led UDF, accusing UDF leaders of back-stabbing him over the issue of bar bribery case.

New Delhi: Prime Minister Narendra Modi on Friday welcomed Canadian Prime Minister Justin Trudeau and his family at the Rashtrapathi Bhavan.

The Canadian Prime Minister was given a ceremonial reception at the Rashtrapathi Bhavan. This meeting comes amid controversy over a Khalistan separatist being a part of the Canadian official delegation’s events.

Earlier on Thursday, Modi tweeted, “I look forward to meeting PM @JustinTrudeau and holding talks on further strengthening India-Canada relations in all spheres. I appreciate his deep commitment to ties between our two countries.”

It should also be noted that Prime Minister Modi spoke about Trudeau for the first time after almost five days since the Canadian PM arrived in India.

Modi tweeted, “I hope PM @JustinTrudeau and his family had a very enjoyable stay so far. I particularly look forward to meeting his children Xavier, Ella-Grace, and Hadrien. Here is a picture from my 2015 Canada visit, when I’d met PM Trudeau and Ella-Grace.”

The Indian Prime Minister’s tweet was whole heartedly welcomed by Trudeau and he replied, “She remembers it well, @narendramodi! It’s been great to visit so far – we’ll see you today.”

New Delhi: The Supreme Court Thursday asked if a roving inquiry could be ordered into the “issue of consent” between two adults who married at will and if the Kerala High Court order annulling the marriage of Hadiya, an alleged victim of ‘love jihad’, was justified.

The questions from a bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud came during the hearing of the Kerala conversion case.

“What troubles us is whether there can be a roving inquiry into the issue of consent between two adults who have agreed to marry,” the bench said. Whether the high court was justified in nullifying the marriage is a pure question of law, it added.

“Marriage and investigation are two different things. As far as marriage is concerned, it does not warrant any investigation. Investigation has nothing to do with it. You can investigate any other thing,” the court said.

Hadiya, the 25-year-old woman who is at the centre of an alleged love jihad controversy, had on Tuesday filed an affidavit before the top court claiming that she willingly converted to Islam and wants to live with her husband Shafin Jahan. The matter had come to fore when Jahan had challenged the Kerala High Court’s order annulling his marriage with Hadiya and sending her to her parents’ custody.

On November 27 last year, the apex court had freed Hadiya from her parents’ custody and sent her to college to pursue her studies, even as she had pleaded that she should be allowed to go with her husband.

Senior advocate Shyam Divan, appearing for Hadiya’s father, said it was a case of vulnerable adults and the high court was justified in nullifying the marriage by exercising its power under Article 226 of the Constitution.

“In this case, marriage was used as a pretext to keep it out of the court’s jurisdiction,” Divan said.

Hadiya had urged the court to set aside the judgement of the Kerala High Court that had annulled the marriage terming it an instance of ‘love jihad’.

Although Divan pleaded with the bench to look into the NIA reports on the smuggling of people to terror groups like the ISIS, the bench said that such issues could be dealt by the government and reiterated that the subject being discussed here was whether a court can annul a marriage between consenting adults.

The bench observed that the government can regulate a person’s right to travel abroad, but here the question is whether the court can annul a marriage or not.

In her affidavit filed on Tuesday, Hadiya described the circumstances under which she converted to Islam from Hinduism – she said that she had been kept under prolonged confinement without the freedom she is entitled to.

The affidavit was filed after the SC made her a respondent in the case.

“Even now I am under police surveillance. I most humbly pray that my entire liberty may kindly be restored to me,” she said.

The bench posted the case for further hearing on March 8.

New Delhi: The Supreme Court on Thursday will continue hearing in the controversial Hadiya case. Hadiya alias Akhila had on Wednesday told the Supreme Court that she had willingly converted to Islam and wants to remain a Muslim.

The apex court rejected the request of Hadiya’s father Asokan K M to adjourn the hearing scheduled for Thursday.

In an affidavit filed before the top court, 25-year-old Hadiya also said that she had married Shafin Jahan on her own and sought the court’s permission to ‘live as his wife’. She has also claimed that her husband was wrongly portrayed as a terrorist by the National Investigation Agency (NIA) and he has nothing to do with the Middle East-based terror group ISIS.

Lima: At least 44 people were killed and 24 others injured when a bus skidded off the road and plunged into a river in Peru’s Arequipa region, authorities said.

Seven of the injured are in serious condition, including three children, reports Efe news agency.

The accident occurred on Wednesday on the Pan-American Highway.

The authorities were still trying to determine what caused the bus to skid off the road and plunge 200 metres into the Ocona River.

The bus was travelling from Chala to Arequipa city, and was running on an expired operating permit, the transportation ministry said.

“My condolences to the families of the victims of the transit accident in Arequipa,” President Pedro Pablo Kuczynski tweeted.

New Delhi: A Delhi court on Wednesday sent two Aam Aadmi Party MLAs — Amanatullah Khan and Prakash Jarwal — who were arrested on charges of assaulting Delhi Chief Secretary Anshu Prakash — in judicial custody till Thursday.

On Wednesday, Metropolitan Magistrate Shefali Barnala Tandon refused a Delhi Police plea for police custody of Khan and Jarwal and said their bail pleas will be taken up on Thursday.

While Jarwal was arrested on Tuesday night, Khan surrendered at a city police station on Wednesday.

This came after the Chief Secretary alleged that he was beaten up by the two MLAs in the presence of Arvind Kejriwal at the Chief Minister’s residence on Monday night, where he had been called for a meeting.

On Tuesday, Delhi Environment Minister Imran Hussain was manhandled at the Delhi Secretariat by a crowd protesting against the alleged assault and his Personal Secretary Himanshu Singh was beaten up, according to multiple video clips from the Secretariat.

Medical examination reports on Wednesday revealed injuries both on the Chief Secretary and the Minister’s aide.

The Chief Secretary paid a visit to the Prime Minister’s Office on Wednesday evening, but did not brief on what transpired in the meeting at the PMO.

On Wednesday evening, the senior officer did not turn up for a Delhi Assembly committee meeting which AAP Chief Spokesperson Saurabh Bharadwaj said was “contempt of Assembly” and the committee was thinking of initiating “contempt proceedings” in the matter.

Bharadwaj said the Chief Secretary and two other IAS officers did not turn up because of an IAS Association’s decision on Tuesday that officers will not meet or talk on phone with the Chief Minister or his Ministers or party MLAs till Kejriwal apologised and took action on the alleged assault.

Informed sources told IANS that as far as they knew, Indian Administrative Service officers did not have any meetings at all with Delhi Ministers on Wednesday, going by their decision.

The Chief Secretary’s medical examination revealed “mild swelling behind both ears” and “bruise over lower lip”. The report termed the nature of injuries “simple” and the weapon used as “blunt”.

Meanwhile, the ministerial aide’s medical report shared by a Delhi government spokesperson revealed “multiple bruises seen all over back, linear in shape”.

Speaking about the Chief Secretary’s absence in the Assembly meeting, Bharadwaj said: “The Committee members feel that against all these people and against IAS Association leaders, contempt proceedings have to be taken up. The committee has not taken a decision yet, but will think about it.”

The MLA said that the Chief Secretary was supposed to come for the meeting at 5 p.m., but he and two other IAS officers did not turn up despite the panel waiting for them till 6.15 p.m.

Earlier in the day, Kejriwal’s adviser V.K. Jain was questioned at the Civil Lines police station and let off.

The alleged assault on the top bureaucrat triggered a political storm on Tuesday, with the opposition Bharatiya Janata Party (BJP) demanding Kejriwal’s resignation and the Congress seeking his apology.

The AAP hit back by accusing the Chief Secretary of making false allegations and said he was working at the “behest of the BJP”.

The Home Ministry sought a report from Lt Governor Anil Baijal as Union Home Minister Rajnath Singh said he was “deeply pained” by the development. The L-G has since submitted a report on the issue to the Home Ministry.

IAS Association Secretary Manisha Saxena told IANS that they would stick to their decision of not meeting Delhi Ministers.

Auckland: Australia cruised to a 19-run victory in a rain-affected T20 tri-series final with New Zealand on Wednesday to claim the world No. 1 ranking in the shortest form of the game for the first time.

New Zealand struggled to 150 for nine after electing to bat first at Auckland’s Eden Park. The Black Caps batsmen failed to repeat the pyrotechnics that saw them score 243 against Australia at the same ground last Friday.

Australia’s bowlers avenged that pasting as they tore through New Zealand’s middle order, led by spinner Ashton Agar’s career-best T20 figures for three for 27.

Ross Taylor’s 43 of 38 balls was the highlight of a poor New Zealand batting display that included just five sixes, despite Eden Park’s notoriously short boundaries.

Australia never looked in danger of missing the 151-run target but the manner in which the victory came was anti-climatic.

The players were off the pitch when officials decided to abandon the match due to persistent rain, awarding Australia a 19-run win under the Duckworth-Lewis system. The result means David Warner’s men complete the tri-series undefeated, notching up convincing wins in all their five matches against New Zealand and England.

It also means Australia leapfrog Pakistan to become the top-rated T20 team, the first time they have held the No. 1 spot since rankings were introduced in 2011.

“I’m over the moon, right from the get-go we played superb cricket,” Warner said, crediting the series win to the skills his players learned in Australia’s domestic Big Bash League.

“It just shows the great depth we have in Australian cricket. The clarity and roles that these individuals have at Big Bash level can (also) be executed on the international stage.”

New Zealand openers Martin Guptill and Colin Munro made their intentions clear with a flurry of boundaries in the early overs. They raced to 48 without loss but Warner held his nerve and backed his attack to take early wickets, constantly switching bowlers so the batters could not settle. Lanky paceman Billy Stanlake made the breakthrough in the fourth over when Guptill departed for 21 after sending his shot straight to Warner.

Munro followed for 29 in the next over leaving the New Zealanders at 59 for two. An Agar double strike in the seventh over then sent the Black Caps’ innings spinning out of control, as skipper Kane Williamson and Mark Chapman both failed to reach double figures.

Agar was not done, tempting a rash shot from Colin de Grandhomme to send the big-hitting dangerman back to the pavilion for 10. Taylor and Ish Sodhi combined for a 38-run partnership but it was too late to revive the innings.

The only negative for Australia was when Chris Lynn left the field after dislocating his troublesome shoulder. Australia made a solid start, with D’Arcy Short beginning to lift the run rate before a 20-minute rain delay. It slowed Short’s momentum and he was dismissed shortly after bringing up his 28-ball half-century.

Warner soon followed on 25 and Agar’s stumping had the tourists looking vulnerable on 83 for three. But Aaron Finch and Glenn Maxwell had Australia cruising and the win was not in doubt before the final rain shower ended the match.

Kochi: Kerala high court has disqualified Consumerfed MD Ramanunni. The court also ordered him on Wednesday to relinquish his position at the earliest. The action comes in response to the petition filed by former Consumerfed member O V Appachan.

Appachan filed the petition stating that  Ramanunni’s appointment was illegal as it didn’t follow the rule that those appointed as Consumerfed MD should be a person already in the government service.

The court also accepted Appachan’s argument that at the time of his appointment as Consumerfed, he was just Thrissur Cooperative bank general manager.
