M_Id_444484_gangrapeNew Delhi: A Delhi court has acquitted a man of the charges of sexually harassing and molesting his 17-year-old daughter after the girl said she had lodged a false complaint due to differences between her parents.

Additional Sessions Judge Gautam Manan absolved the man, a resident of north Delhi, of the offences under sections 354 (molestation), 506 (criminal intimidation) of IPC and section 12 (sexual harassment) of Protection of Children from Sexual Offences (POCSO) Act, noting that the girl and her mother did not support the case.

“The girl has resiled from the allegations made in the complaint and her mother has also not supported prosecution version and deposed that the girl never disclosed about any sexual harassment on her by the accused,” the judge said.

The court, while acquitting him, also noted that the mother-daughter duo maintained that due to matrimonial disputes between the girl’s mother and the accused, the complaint was lodged, “Hence, allegations against the accused stand not proved”.

According to the police, the complaint was lodged by the girl, who alleged that on August 31, 2013, when she was sleeping, her father molested her and threatened her.

She narrated the incident to her mother the next day and the man was not allowed to enter the house for several days, it said, adding that he again forced himself inside the house and molested her besides threatening to kill the girl.

He was arrested a few days later and was charge-sheeted. During the trial, he pleaded innocence and claimed he was falsely implicated.
